Working with You
Our services may be structured and intended to be under, and within the scope of services you receive from your lawyer. As such, these services may be within your and your lawyer's Attorney-Client privilege.
This does not at all result in us being your lawyer. Rather, it would be similar to the receptionist or paralegal in your lawyer's office being within the scope of privilege between your lawyer and you.
Among the services for you and your lawyer will be reports in which the initial proposal for division and allocation of marital assets is analyzed. There will be continuing reports for all modifications of the proposals, as well as us offering alternatives to them.
Each report will minimally set forth the following:
- Marital assets and debts, and their percentage allocations.
- Income, child support transfers and household expenses of you and your spouse, and stated projections for their increases over time.
- Allocation of retirement accounts such as pensions, profit sharing and 401[k] plans, and IRA's, and their projected growth.
- Income and earnings on investments as allocated, and value increases in non-income producing properties.
The above factors will be set out in reports that will include in a graphic year-by-year format, the implications to you and your spouse on the following three critical economic and financial factors:
- Net Worth,
- Cash Flow, and
- Working Capital
Two other areas of great financial implication are the retirement benefits that accrued during the marriage and closely-held or "family" businesses. For these benefits, we can provide the following
- Analysis of the value of the benefit, as of the divorce and eventually upon distribution,
- Determination of available methods to divide and allocate the benefit under the plan through which the benefit if provided, and
- Assist in the design and development of the resulting QDRO.
And as concerns a family business, we can provide forensic analysis of
- cash flow and income,
- corresponding expenses, and
- identify the economic and financial aberrations that can occur in these businesses shortly before a divorce is contemplated by the principal of the business.
